Overview

This website is operated by Try Sapura (“we”, “us”, “our”), a company based in the Netherlands (Chamber of Commerce no. 90189876). By visiting our site or buying from us, you agree to these Terms of Service (“Terms”) and the policies they reference: our Return & Refund Policy, Shipping Policy, Subscription & Cancellation Policy, Privacy Policy and Consumer Health Data Privacy Policy. If you do not agree, please don’t use the site.

Our store is hosted on Shopify.

Section 1: Online Store Terms

By agreeing to these Terms, you confirm that you are at least the age of majority where you live. You may not use our products or site for any illegal or unauthorized purpose, or transmit any viruses or destructive code.

Section 2: Product Use and Health Disclaimer

  • Try Sapura products are personal care and cosmetic products. They are not intended to diagnose, treat, cure or prevent any disease, and have not been evaluated by the FDA or any equivalent regulator.
  • Content on this site, including results, percentages and customer reviews, is for general information only and is not medical advice. Individual results vary.
  • If you have a persistent, spreading or severe skin condition, or are pregnant, nursing, diabetic or immunocompromised, talk to a doctor before use.
  • Our products contain [key ingredients, e.g. persimmon extract] and other botanicals. Patch test on a small area for 24 hours before first use. Stop use and consult a doctor if redness, burning, swelling or irritation occurs. For external use only. Avoid eyes and broken skin. Keep out of reach of children.

Section 3: Orders and Formation of the Contract

  • Product information on our site is an invitation to order. A contract between you and Try Sapura is formed when we send you an order confirmation by email after your payment has been accepted.
  • Before placing your order, you can review and correct your details at checkout.
  • We store your order details and send them to you in the confirmation email.
  • Contracts are concluded in English.

Section 4: General Conditions

We may refuse service to anyone for any lawful reason. Your content (not including payment information) may be transferred unencrypted over networks. Payment information is always encrypted. You may not reproduce, resell or exploit any part of the site without our written permission.

Section 5: Accuracy of Information

We work to keep the information on this site accurate. If we find an error in a product description, price or availability, we’ll correct it. If it affects an order you’ve already placed, we’ll contact you, and you can cancel for a full refund.

Section 6: Prices, Products and Orders

  • Prices and products may change without notice, but changes never affect orders you have already paid for.
  • Prices shown at checkout include any applicable taxes, unless stated otherwise. Shipping costs are shown at checkout before you pay.
  • We may limit quantities per person, household or order, and may refuse orders that appear to be placed by resellers. If we cancel an order, we’ll notify you and refund you in full.
  • Product images are shown as accurately as possible, but colors may vary by screen, and packaging may differ slightly from the images.

If you are a consumer in the EU or UK, you have the right to withdraw from your purchase within 14 days of receiving it. You are also entitled to a legal guarantee for products that are faulty or not as described. How to use these rights is explained in our Return & Refund Policy. Nothing in these Terms limits the rights you have under the mandatory consumer laws of your country or state of residence.

Section 9: Accuracy of Billing and Account Information

You agree to provide current, complete and accurate purchase and account information, and to update it promptly so we can complete your orders and contact you.

Section 10: Third-Party Tools and Links

We may provide access to third-party tools or links to third-party websites we don’t control. We are not responsible for their content, products or practices. Please review their terms before using them.

Section 11: Reviews, Comments and Submissions

If you send us reviews, photos, ideas or other content (“Submissions”), you allow us to use, edit and publish them in any medium. We will only publish your photo or full name with your permission. Reviews reflect individual customers’ experiences. You agree that your Submissions won’t be unlawful or misleading, won’t infringe anyone’s rights, and won’t contain malware.

Section 13: Prohibited Uses

You may not use the site:

  • (f) to collect others’ personal information
  • (g) to spam, phish, scrape or crawl
  • (h) to interfere with the site’s security.

We may terminate your access if you violate these uses.

Section 14: Disclaimer of Warranties and Limitation of Liability

We don’t guarantee that the site will be uninterrupted or error-free. Except as expressly stated by us (including the 60-Day Guarantee) and except for your statutory rights, the site and products are provided “as is”, to the extent permitted by law.

To the maximum extent permitted by law, Try Sapura and its directors, employees, affiliates and suppliers are not liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the site or products. Our total liability for any claim relating to a product is limited to the amount you paid for that product.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or intent, or any other liability that cannot be excluded by law. This includes your statutory rights under the consumer laws of your country, such as EU consumer law, the UK Consumer Rights Act and the Australian Consumer Law.

Section 15: Indemnification

To the extent permitted by law, you agree to indemnify Try Sapura and its affiliates, officers, employees and suppliers against third-party claims, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or third-party rights.

Section 16: Severability

If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted, and the rest of these Terms remain in effect.

Section 17: Termination

These Terms apply until terminated by you or us. We may terminate these Terms or your access if you breach them. Obligations incurred before termination survive it.

Section 18: Entire Agreement

These Terms and the policies they reference are the entire agreement between you and us about the site. Our failure to enforce any right is not a waiver of it.

Section 19: Governing Law and Dispute Resolution

These Terms are governed by the laws of the Netherlands. If you are a consumer, you keep the protection of the mandatory laws of your country or state of residence.

If you have a dispute with us, please email info@trysapura.com first. We’ll try to resolve it informally within 30 days.

If we can’t resolve it, disputes will be submitted to the competent court in the Netherlands. If you are a consumer, you may also bring a claim in the courts of your country of residence where the law allows it, including small claims courts.

Section 20: Changes to These Terms

We may update these Terms by posting changes on this page with a new “Last updated” date. Changes apply to orders placed after they’re posted, not to earlier orders.
